Welcome to AI Ads Market. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Overview

AI Ads Market ("Platform", "we", "us", "our") is a marketplace connecting businesses ("Buyers") with creators ("Creators") who produce AI-powered advertisement creative services. These Terms govern your use of our website, mobile applications, and all related services.

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Platform. By creating an account, you represent that you meet these requirements.

2.2 Account Types

  • Business Accounts: For companies and individuals seeking advertisement creative services
  • Creator Accounts: For individuals and agencies offering advertisement creative services

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

3. Platform Fees

3.1 Fee Structure

The Platform charges a service fee on all transactions. Currently, this fee is 18% of the order total, which is added to the base price set by Creators. This fee covers:

  • Payment processing
  • Platform maintenance and development
  • Customer support
  • Escrow protection for all orders

3.2 Fee Modifications

We reserve the right to modify our fee structure at any time. Changes will be announced via email and on the Platform at least 30 days before taking effect. Your continued use of the Platform after fee changes constitutes acceptance of the new fee structure.

3.3 Payment Terms

  • All prices are displayed in USD
  • Payments are held in escrow until order completion
  • Creators receive payment after successful delivery approval or auto-release (7 days after delivery)

4. Creator Terms

4.1 Creator Approval

Creator accounts require approval before accessing all Platform features. We maintain a limited number of Creator slots (currently 100, subject to change) to ensure quality. Approval is at our sole discretion.

4.2 Listing Requirements

All listings must:

  • Accurately describe services offered
  • Include appropriate examples of work
  • Comply with our Content Guidelines
  • Be priced fairly and transparently

4.3 Delivery Obligations

Creators must:

  • Deliver work within the timeframe specified in the order
  • Provide work that matches the listing description
  • Respond to revision requests in a timely manner
  • Maintain professional communication with Buyers

5. Prohibited Activities

5.1 Off-Platform Transactions

You are strictly prohibited from conducting transactions outside the Platform. This includes:

  • Sharing personal payment information (PayPal, Venmo, bank details, etc.)
  • Requesting or making payments outside the Platform
  • Circumventing Platform fees in any way

Violation of this policy may result in immediate account suspension and forfeiture of any pending payments.

5.2 Communications

Messages sent through the Platform may be reviewed to help prevent fraud and ensure a safe marketplace for all users.

5.3 Other Prohibited Activities

  • Providing false or misleading information
  • Harassing, threatening, or abusing other users
  • Uploading malicious content or malware
  • Creating multiple accounts to circumvent restrictions
  • Manipulating reviews or ratings
  • Infringing on intellectual property rights

6. Orders and Payments

6.1 Order Process

  1. Buyer places order and payment is held in escrow
  2. Creator accepts and begins work
  3. Creator delivers completed work
  4. Buyer reviews and approves (or requests revision)
  5. Payment is released to Creator upon approval

6.2 Auto-Release

If a Buyer does not respond within 7 days of delivery, funds are automatically released to the Creator.

6.3 Refunds and Cancellations

  • Cancellations before Creator acceptance receive full refunds
  • Cancellations after work begins are subject to dispute resolution
  • A 10-day dispute window applies to cancelled orders before refund processing

7. Disputes

7.1 Dispute Process

Either party may file a dispute for orders that do not meet expectations. Disputes are reviewed by our support team, who may:

  • Request additional information from both parties
  • Mediate a resolution
  • Issue full or partial refunds
  • Release full or partial payment to Creator

7.2 Decision Finality

Platform decisions on disputes are final and binding.

8. Affiliate Program

8.1 Program Overview

Users may participate in our affiliate program by sharing their unique referral link. Affiliates earn 3% commission on all orders placed by referred users.

8.2 Attribution Window

Referrals are attributed for 31 days from the initial click on your affiliate link. After sign-up, commissions are earned on all future orders from that user indefinitely.

8.3 Payout Terms

  • Minimum payout: $10 USD
  • Commissions become available after order completion
  • Payouts are processed via Stripe

9. Reviews

9.1 Review Guidelines

Reviews must be honest and based on actual experiences. Incentivized, fraudulent, or misleading reviews are prohibited.

9.2 Review Visibility

Reviews are hidden until both parties have submitted their review, or after 14 days, whichever comes first. This ensures unbiased feedback.

10. Intellectual Property

10.1 Content Ownership

  • Creators retain ownership of their original work until payment is completed
  • Upon payment completion, Buyers receive full commercial rights to delivered work
  • Creators may retain the right to use work in portfolios unless otherwise agreed

10.2 Platform Content

All Platform content, including logos, trademarks, and software, remains our property.

11. Limitation of Liability

To the maximum extent permitted by law, AI Ads Market shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

12. Indemnification

You agree to indemnify and hold harmless AI Ads Market, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email and platform notification. Your continued use of the Platform constitutes acceptance of modified Terms.

14. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our sole discretion. Upon termination:

  • Pending orders will be handled according to our cancellation policy
  • Earned but unpaid funds will be released within 30 days
  • Access to the Platform will be revoked

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
